Analyse Fundamental Concepts and Principles of EU Intellectual Property Law:
Identify and explain the basic principles of IP Rights, such as immateriality, exclusivity, ubiquity and time-prioritization
Evaluate the common features and disparities among specific intellectual property rights, emphasizing the “ratio”/justification grounds behind their protection
Acknowledge the impact and role of intellectual property rights on the economy of the European Union (EU), especially in the digital era
Examine Legislative Regimes of IP Rights and evaluate the results of the unified protection, offered to some of them, as opposed to harmonization, applied to others
Compare the legislative regimes governing trademarks, patents and copyright within the European Union (EU)
Differentiate between unification (applicable to trademarks and –partially- to patents) and harmonization (applicable to copyright) and assess their implications
Conceptualize Bodies/Institutions Responsible for Intellectual Property Protection within Europe
Identify and describe the relevant bodies and institutions within the EU responsible for the registration procedures of intellectual property rights, such as trademarks and patents
Assess the role of these bodies/institutions in implementing and upholding intellectual property rights within the legal order of the EU
Understand the meaning/content and assess the implications of the “no formalities” protection granted to works by Copyright Law, within the EU
Understand the Legal Nature and analyze the Economic Exploitation of IP Rights
Examine the legal nature, subject matter and beneficiaries of trademark, patent and copyright protection, including limitations & exceptions for the protection of public interest(s)
Evaluate the economic exploitation of these rights through licenses and contracts, defining the conditions and limits of their 'legitimate use' and specifying the notion of infringement
Acknowledge the importance of interpretation principles and rules applied to the above exploitation contracts/licenses at an EU level
