Learning Outcomes

Course Content (Syllabus)
GENERAL LEGAL THEORY 1. The object of study of the General Legal Theory (GeLThe). Theoretical and practical use of GeLThe. The foundations of Law. Legal thought. The objectives of Law. The distinction between legal and ethical rules. The nature of Legal Science. 2. The sources of Law: heterogeneity of the sources, relations between the sources, general principles of law: their significance and their position in the hierarchy of legal rules. 3. The environment of the Law: a) Law and time (the Law in time and the time in Law), b) Law and space (Law in space and the space in Law), c) Law and nature, d) Law and society. 4. The “tools” of law: Legal institutions (definition, applicability) b) Legal concepts and legal categories (definition of the concepts and identification of the categories, methods of categorization). 5. Legal terminology, legal language (particularity, technical nature, structure, the communicative functions of legal terminology). 6. Theories concerning the validity and the mandatory nature of legal rules (Kelsen, Ross, Hart, Bobbio and so on). 7. The implementation of Law: a) Principles and methods for the interpretation of legal texts, b) Principles of evaluation of behaviors, c) The structure of syllogisms and the legal syllogism: aa) Typology of syllogisms and the particularity of the legal syllogism; bb) Subsuming real facts under legal rules. 8. The judge and the trial: a) the role and function of the judge, b) General principles of court organization and their competencies, c) General principles governing the trial and types of jurisdiction. 9. Rhetoric and techniques of persuasion. 10. The techniques of mediation and negotiation.La théorie générale du droit a pour objet de saisir, dans sa totalité et dans toutes ses dimensions possibles, le phénomène juridique tel qu'il est, par l'étude de la raison d'être de ses finalités, de ses concepts fondamentaux, de sa mise en oeuvre, de ses instruments, de ses méthodes, de ses modes d'application. Sommaire du Cours de Théorie Générale du Droit C'est aussi une tentative de recherche méthodique, au delà des particularités, des modes de raisonnement et des mécanismes intertemporels et universels du pourquoi et du comment de la pensée juridique.
