Learning Outcomes
The students through lessons will get to know the senses of the communion of a right, of the mandate, of the another’s affairs management (negotiorum gestio), of the guarantee, of the non causal promise or recognition of a debt and of the compromise
The students through lessons will get to know the obligations arised for the involved parties and the consequences of its breach.
The students through lessons will get to know the jurisprudence of our courts on the relevant matters and will get to acquire the ability of manage relevant matters

ELE 22. SPECIAL FORMS OF OBLIGATIONS (COMMUNION OF A RIGHT, MANAGEMENT OF ANOTHER’S AFFAIRS - NEGOTIORUM GESTIO, MANDATE, GUARANTY, NON CAUSAL PROMISE OR RECOGNITION OF A DEBT, COMPROMISE)
Communion of a right
Sense and legal nature of the communion, rights and obligations of the communions’ members, their relations to third persons, regular and judicial administration of the right, dissolution of the communion, out of court and judicial one
Management of another’s affairs (negotiorum gestio)
Kinds of negotiorum gestio (genuine permitted, genuine unpermitted and non genuine) and legal consequences of each kind.
Mandate
Sense, form, obligations of the mandatary and substitution of him, obligations of the mandator, dissolution of the mandate, paid legal mandate
Guaranty
Sense, distinction from relative senses (counter-guaranty, after-guaranty, mandate to credit a third person, cumulative assumption of a debt, promise to release from a debt, patron’s declaration), obligation between guarantor and principal debtor (content of the obligation, exception of discussion, exceptions of the principle debtor), dissolution of the guaranty (generally, at the guaranty of certain and uncertain time)
