Learning Outcomes
Development of the ability of the students to approach and understand the methods of appeal as well as the principles and means of enforcement, through lectures, practical cases and court decidions. The students that have successfully attented the cource will be able to deal with complex matters of appelate and enforcemenet proceedings, to draft legal documents and to comprehend judicial decisions.
Course Content (Syllabus)
The part of the cource dealing with remedies covers both a general introduction to the law of remedies as well as a specific overview of the individual remedies, particularly the so called ordinary methods of review (opposition against default, appeal).Issues of admissibility of the above remedies as well as rules governing the hearing and the results of the remedies are confronted.
The part of the cource dealing with enforcement proceedings involves both the general part of the eighth book of the Code of Civil Procedure, namely prerequisities, parties, oppositions to enforcement etc., as well as the specific part of the enforcement and in particular the different means of enforcement (attachment, public auction etc).
