Learning Outcomes
After the successful completion of the course the students will: - fully comprehend the notions of the communion of a right, the mandate, the conversion of affairs, the guarantee, the non causal promise or recognition of a debt and the compromise - have understood the obligations arising for the involved parties and the consequences of their breach - have gotten acquainted with the relevant jurisprudence of the courts - reason and resolve legal cases on issues concerning the materials covered in the course.

Course Content (Syllabus)
SPECIAL FORMS OF OBLIGATIONS (COMMUNION OF A RIGHT, MANAGEMENT OF ANOTHER’S AFFAIRS - NEGOTIORUM GESTIO, MANDATE, GUARANTY, NON CAUSAL PROMISE OR RECOGNITION OF A DEBT, COMPROMISE) Communion of a right (Sense and legal nature of the communion, rights and obligations of the communions’ members, their relations to third persons, regular and judicial administration of the right, dissolution of the communion, out of court and judicial one). Management of another’s affairs (negotiorum gestio) (Kinds of negotiorum gestio (genuine permitted, genuine unpermitted and non genuine) and legal consequences of each kind.). Mandate (Sense, form, obligations of the mandatary and substitution of him, obligations of the mandator, dissolution of the mandate, paid legal mandate). Guaranty (Sense, distinction from relative senses (counter-guaranty, after-guaranty, mandate to credit a third person, cumulative assumption of a debt, promise to release from a debt, patron’s declaration), obligation between guarantor and principal debtor (content of the obligation, exception of discussion, exceptions of the principle debtor), dissolution of the guaranty (generally, at the guaranty of certain and uncertain time). Non causal promise or recognition of a debt (Sense, form and other validity’ prerequisites, consequences. Distinction from the causal promise or recognition of a debt). Compromise (Sense, legal nature, consequences, nullity, annulment).
