DIGITAL NETWORK TRANSACTIONS AND EU LAW

Expected Learning Outcomes a) describe the basic concepts of system and network theory and analysis. Students should be able to understand: • how a system is formed, its basic elements and properties and the concepts of system state and attractor • the concept of open dynamic system and the distinction between linear and non-linear systems and be able to recognize them • the concept of complexity and its main attributes focusing on emergence and the multilevel organizational structure • the correspondence between system and network, the basic types of networks b) understand the basic characteristics of the various types of contractual networks, the structural problems that arise for each different type, mainly hierarchical and P2P networks, as well as the possible solutions to these problems • issues of formation of contractual networks, entry and exit mechanisms • liability both internal and external • contractual governance mechanisms • dissolution of contractual networks c) utilize the concept of good faith in order to overcome the privity of contract • secondary duties owed to third parties and the network as a whole d) grasp peculiar legal features such as “steward ownership”, quasi-associations and linked contracts as well as the role of distributive justice for cooperation in organizations
