Prerequisites
General Prerequisites
The course has no formal prerequisites. In order for participants to be able to better understand the terms, concepts and the issues involved during the course, it is useful to have prior familiarity with basic concepts of cadastral law.
Learning Outcomes
Involvement and understanding of specific issues of land law litigation, such as the inverse of the legal consequences of the litigation of contested jurisdiction (article 6 § 2 of Law 2664/1998) from that of voluntary jurisdiction (articles 6 § 3, 16 § 5, 18 § 2 and 19 § 2 of Law 2664/1998). 2664/1998), the res judicata and the bifurcation of the court decision that occurs in the land register proceedings, cases of extension of the subjective limits of land register proceedings and, of course, the removal of the pendency created by the refusal to register a deed in the land register sheets, as well as jurisprudential applications of decisions of forest map objection committees. The correction of geometric changes is also studied, as well as special issues from the confluence of legal remedies for the correction of first (initial) or later inaccurate cadastral records. In general, understanding and attempt to solve fundamental problems of procedural land law, as reflected in the theory and recent case law of both substantive courts and the Supreme Court.
