Learning Outcomes
Specialisation in specific problems of substantive land law. Develop the ability to identify and understand the main interpretative issues arising from the gradual transition from the system of transfers and mortgages to the cadastre. In general, understanding and attempting to solve fundamental problems of substantive land law, as reflected in the theory and recent case law of both substantive courts and the Supreme Court, especially regarding institutions such as those of special forms of usufruct (Law No. 3127/2003, Israeli community properties, etc.), expropriation, the deed of implementation, the ratification of anomalous legal transactions, Protocols and public lands, common property, as well as the land bank and historical property in the National Cadastre.
Course Content (Syllabus)
The course focuses in particular on institutions such as special forms of usufruct (Law 3127/2003, Israeli community property, etc.), expropriation, the deed of implementation, the validation of anomalous legal transaction, Protocols and public lands, common property, as well as the land bank and historical property in the National Cadastre. Rights in rem (in particular ownership and servitudes) in private forests are also considered.
