Learning Outcomes
By completing the class, students will be able to: - understand in practice the relationship between statutory law and higher law (the constitution, international and EU law). - understand the particularities of the Greek system of judicial review of legislation, as well as its relation to the main families of judicial review systems (constitutional court systems - diffuse systems - the so-called 'Commonwealth model') - know under which terms they can ask Greek courts to review a statute for its conformity with the constitution, international law or EU law. - grasp the significance of the "constitutional jurisprundence", whose question is wether to apply a given statute or not, in relation to the ordinary jurisprudence, whose question is how to interpret a given statute, as well as to grasp the various "in-between" techiques (between review and statutory interpretation), such as the statutory interpretation in conformity with the constitutiona, or international or EU law.

Course Content (Syllabus)
Ι.a. Systems of judicial review of legislation: Constitutional court systems - Diffuse review systems - The 'Commonwealth model' b. The main distinction of the judicial review systems: Review of the law as such (abstract) - Review of the particular application of the law (concrete) ΙΙ. Characteristics of the judicial review of legislation in Greece: diffuse - incindentary - concrete - declaratory. Characteristics of the judicial review exersised by the Highest Special Court (AED) ΙΙΙ. The actors of judicial review: National courts - The influence of the jurisprudence of highest courts - The Highest Special Court - The influence of the jurisprudence of the European courts (ECJ - ECtHR) ΙV. Procedural access to judicial review: Direct review of administrative rules - Incidentary review of statutory law - Access to AED. V. Forms of judicial review: Constitutionality - Compatibility with international law, especially the ECHR - Compatibility with EU law. VI. Results of judicial review: Non-application of the law - Interpretation of the law (in conformity with the constitution/International law/EU law) - Abolition of the law (by AED). VII. Non-judicial review: Political review (parliamentary - by the President of the Republic) - Admnistrative review - Review by independent authorities.
