Learning Outcomes
The students will a) know the notion, the medieval origin and the exegetic method of interpretation of a Digest's text, b) be trained in the subsumtion of historical cases in Roman legal rules, c) be familiarised with the latin legal terminology, d) know legal maxims of latin origin which belong to the modern legal education as well, e) know information about the work of classical roman jurisprudents and also of glossators and commentators of the middle ages as well, f) be trained in the methodology of writing a Digest's Exegesis. Die Studenten/-innen werden a) die Bedeutung, die mittelalterliche Herkunft und die Methode der Digesten Exegese kennenlernen, b) in der Bearbeitung von Digestenstellen trainieren, c) mit der lateinischen juristischen Terminologie, die zur modernen juristischen Ausbildung auch gehoeren, vertraut werden d) die Herkunft von Grundprinzipien, die heutzutage immer noch in ihrer diachronischen lateinischen Formulierung benutzt werden, lernen, e) Informationen ueber das Werk von klassischen roemischen Juristen und auch von Glossatoren und Kommentatoren vom Mittelalter lernen, f) in der Verfassung einer Digesten Exegese trainiert werden.

Course Content (Syllabus)
DIGEST’S EXEGESIS OF ROMAN PRIVATE LAW The exegetic method has been established as a method of interpretation of Justinian’s Digest since the middle ages. It still remains part of the European Legal Studies and it is traditionally offered as a course in german universities. The Exegesis (gr. ἐξήγησις) is a method of explanation and interpretation of a Digest’s text. The Digest of Justinian is a collection of texts of the flourishing classical period of Roman Jurisprudence. Students are dealing with cases and problems of Private Law that may be arisen as modern legal issues as well. Aim of the course is to train students in legal argumentation and structural legal thinking and also in reconstructing a historical case with emphasis on the legally relevant points of it. Roman Law has been fundamental for the European legal culture. The Study of History of Law today contributes to the enrichment of the criteria that a modern jurist uses, in order to find the most fair solution of a legal case. Students are expected to write a Digest’s Exegesis and to present it orally at class. DIGESTENEXEGESE DES RӦMISCHEN PRIVATRECHTS Die Digestenexegese ist seit dem Mittelalter Bestandteil der europäischen Juristenausbildung und wird immer noch an deutschen Universitäten traditionell angeboten. Es handelt sich um die Erklärung, die Auslegung (gr. ἐξήγησις) einer Digestenstelle. Die Digesten, eine Sammlung von Texten der Hochblüte der klassischen Jurisprudenz, sind der Hauptteil der Junistinianischen Kodifikation des römischen Rechts gewesen (6.Jhdt. n.Chr.). Bei der Verfassung einer Digestenexegese lernt man aufgrund von Fällen und Problemen des Zivilrechts, die heutzutage immer noch auftauchen, juristisch zu argumentieren, strukturiert zu denken und einen Sachverhalt unter rechtlichen Gesichtspunkten wiederzugeben. Das römische Recht bildet die Grundlage der europäischen Rechtskultur. Das Studium der Rechtsgeschichte bringt dem modernen Jurist diachronischen Kriterien für sachgerechten Entscheidungen und Methoden zur Falllösungen bei. Im Unterricht wird man eine Digestenexegese schriftlich verfassen und sie mündlich präsentieren.
