Learning Outcomes
Upon successful completion of the course, students have acquired 1) A general perception of intellectual property law 2) Ability to think critically in the field of intellectual property law 3) Ability to deepen on specific sectors of trademark law, patent and copyright law 4) Devepopment of practical skills in order to successfully put the theory into practice
Course Content (Syllabus)
For the purposes of this course, specific topics of Intellectual Property Law have been selected and are going to be taught, with the aim to introduce students into this broad and modern area of Law and provide them with the basic knowlwedge of it. After an introductory presentation of all the (so- called) Intellectual Property Righs (IPRs), the following topics are to be analysed in depth:
1) Introduction in Intellectual Property Law (The presence and meaning of Intellectual Property Law in our everyday lives, the influence of this area of Law on the Economy and Culture and, more specifically, on competition and cultural industry as well as on the developement of creativity and innovation - The "international character" and the basic principles of Intellectual Property Law - The international Treaties and the legal framework of the EU).
2) Introduction in Trademark Law; notion and legal nature, scope and functions of the trademark - types of trademarks - the "creation" of the right on a trademark.
3) The material (legal) prerequisites for the acquisition of a trademark (subjective and objective, positive and negative prerequisites; the so-called "inadmissible" trademarks).
4)The content of the right and its economic exploitation (transfer of rights - license agreements).
5)Loss of right, infringements and violations, protecion of trademarks in the context of civil law.
6)Introduction in Patent Law - the notions of "invention" and patent - material and formal prerequisites for the acquisition of a patent.
7) The owners of the right (patentees), with emphasis on the so-called "patents made for hire" - types of patents - the legal powers of the patentee.
8)The economic exploitation of the patent (transfer, license agreements), the case of compulsory licensing - duration of the right - legal protection.
9) Introduciotn in Copyright and Related/Neighbouring Rights' Law - The notion of "work" (the basic characteristics of the work, originality, various types of works etc.).
10) The notion of the "auhtor" (independent author/creator, the employed author, the author who works for the State (as a public servant) etc.), legal nature of Copyright and the essential characteristics of economic (pecuniary) and moral rights.
11) The economic and moral rights of the author according to L. 2121/1993 (presentation and in depth analysis of the specific rights).
12) Economic exploitation of the works, contracts and licenses of exploitation (exclusive and non-exclusive) - Collective Management Organisations.
13) Exceptions abd limitaions of economic right - Legal protection of copyright.
