Learning Outcomes
Development of the ability to recognise und understand the main interpretative issues related to the taught provisions, to use appropriate interpretative methods for solving them, to present und critically evaluate the opinions supported about them in science and jurisprudence and to apply correctly the provisions in the framework of practical exercises.
Course Content (Syllabus)
In this specific course, the issue of promoting pharmaceutical products will be examined, mainly through advertising and other commercial practices within the framework of current legislation, but also of the Self-Regulatory Codes, which bind the involved advertised companies and advertisers. This section will also comment on important decisions of the Court of Justice of the European Union, regarding the advertising of medicines, especially when it is addressed to the public and the removal of relevant restrictions that are set, with the aim of protecting public health, as well as the related issues will be discussed of constitutionality, set by the restrictions in question. At the same time, issues of unfair but also free competition that have arisen in the context of the marketing of pharmaceutical products will be examined and relevant decisions of courts and authorities, such as the Greek and European Competition Commission, will be analyzed, mainly on issues of parallel imports, as well as national restrictions and equivalent measures effect with a quantitative limitation on cross-border transactions and activities.
