Learning Outcomes
Development of the ability to recognise und understand the main interpretative issues related to the taught provisions, to use appropriate interpretative methods for solving them, to present und critically evaluate the opinions supported about them in science and jurisprudence and to apply correctly the provisions in the framework of practical exercises.
Course Content (Syllabus)
This course will first address the specific issues raised by the provisions on smuggling. The system of administrative and criminal sanctions, the content of the legal form of smuggling, its relation to the crime of fraud and finally the special procedural issues (in relation to the crime caught in the act, arrest, confiscationand general pre-trial procedure, the evidentiary procedure, the civil action and the appellate review) related to the specific act will be analyzed. Then the crimes of disloyalty and defalcation against the State will be examined and the course will be completed with the analysis of the substantive and procedural provisions of the law for the abusers of the state' s property.
